Terms and Conditions for Japan

These Terms and Conditions ("Terms") govern your access to and use of the CareBear mobile application and related services (collectively, the "Application"), which are provided free of charge by Redefine Impacc LLC (the "Service Provider," "we," "us," or "our"). These Terms apply to CareBear users in Japan. Your app language setting does not change which jurisdiction terms apply. If you do not agree with these Terms, do not download, install, access, or use the Application.

1. Scope, Japan Applicability, and Agreement

1.1 These Terms apply to use of CareBear in Japan and should be read together with the Privacy Policy for Japan.

1.2 CareBear helps users configure followers and delayed messages that may be delivered if CareBear detects a possible lost-contact event. CareBear is not an emergency service or a guaranteed safety monitoring service.

1.3 By creating an account, accessing the Application, or continuing to use the Application after these Terms take effect, you agree to these Terms to the extent permitted by applicable law.

2. Definitions

2.1 "Application" means the CareBear mobile application, related backend services, updates, upgrades, support features, and public legal pages.

2.2 "User," "you," or "your" means an individual who accesses or uses the Application.

2.3 "Follower" means a registered CareBear user who accepts an invitation to follow another user and receive limited lost-contact information from that user.

2.4 "Lost Contact" means a situation in which CareBear does not receive expected motion, check-in, or device activity information within the timing configured for the relevant delayed-message or follower relationship.

2.5 "Delayed Message" means message content a user configures for possible delivery to a Follower if a lost-contact alert is triggered.

2.6 "Privacy Policy" means the separate document explaining how CareBear handles personal information and information related to personal information for users in Japan.

3. Intellectual Property Rights

3.1 All trademarks, copyrights, database rights, software rights, designs, and other intellectual property rights in and to the Application are owned by the Service Provider or its licensors.

3.2 You may not copy, modify, translate, reverse-engineer, decompile, disassemble, create derivative works of, or attempt to extract source code from the Application except as expressly permitted by applicable law or with our prior written consent.

3.3 All rights not expressly granted in these Terms are reserved.

4. License and Charges

4.1 Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Application on devices that you own or control.

4.2 The Application is currently provided free of charge. If paid features are introduced later, we will present the applicable price, billing period, renewal terms, cancellation method, refund terms, taxes, and App Store terms before charging you.

4.3 We may modify, suspend, or discontinue the Application or any part of it, subject to applicable law and any non-waivable consumer protections.

5. Age Requirement

5.1 The Application is intended only for users who are at least thirteen (13) years old.

5.2 If you are a minor, you may use the Application only with consent from a parent or legal guardian where required by applicable law.

5.3 If we learn that we have collected personal information from a child under thirteen (13), we will handle that information in accordance with the Privacy Policy.

6. Third-Party Services and Foreign Processing

6.1 CareBear uses third-party services and processing channels to operate the Application, including DigitalOcean for hosting and storage, Apple for Sign in with Apple, Apple Push Notification service (APNs), App Store distribution, and iOS infrastructure, SendGrid SMTP/email systems for email delivery, Functional Software, Inc. / Sentry for diagnostics and error monitoring, and support email systems for support, legal requests, privacy requests, and complaints.

6.2 These providers may process information in Japan, the United States, and other countries where their infrastructure, affiliates, or personnel operate. Foreign processing and provider roles are described in the Privacy Policy for Japan.

6.3 Third-party services operate independently of CareBear and may have their own terms, privacy policies, infrastructure, security practices, and availability limits. We are not responsible for third-party services except to the extent required by applicable law.

7. Followers and Lost Contact

7.1 You may invite one or more registered CareBear users to become Followers. A Follower relationship is created only after the invited user accepts the invitation.

7.2 Accepted Followers may see limited activity metadata before a lost-contact alert is triggered, including latest activity type, latest activity time, and latest check-in time. Followers do not receive all of your activities in real time.

7.3 If a lost-contact alert is triggered, CareBear may create in-app notification records and may send push notifications through Apple Push Notification service (APNs) and email messages that may include your Delayed Message or related alert content. CareBear does not use SMS messages or phone calls for lost-contact alerts unless those channels are added in a future version and described in updated terms, privacy policies or notices, and permission flows where applicable.

7.4 CareBear does not collect GPS, precise location, route history, address, or real-time location as part of the lost-contact workflow.

8. Privacy Policy and Consent Records

8.1 Your use of the Application is subject to the Privacy Policy for Japan, which explains what personal information and information related to personal information we collect, how we use and share it, how we retain it, and how users in Japan may exercise rights or submit complaints.

8.2 Where CareBear uses a Japan-specific consent, acknowledgment, or version-tracking flow, we may record terms version, privacy policy version, locale, country or region, consent type, timestamp, and withdrawal timestamp as described in the Privacy Policy.

8.3 If you do not agree with the Privacy Policy, do not use the Application.

9. Personal Data, Message Content, and Device Security

9.1 You are responsible for the Delayed Message content and other information you enter into CareBear. Do not include passwords, door codes, access credentials, financial credentials, medical records, government identifiers, precise location details, dangerous instructions, illegal content, or another person's personal information unless necessary, lawful, and authorized.

9.2 Delayed Message content may be copied into in-app notifications, push notifications, emails, notification records, and delivery-related records when an alert fires. Push notifications and emails may be visible outside the unlocked app, including on device lock screens, notification previews, email inboxes, and recipient devices.

9.3 We may remove content, refuse to deliver content, disable features, block invitations, or suspend or terminate accounts if we believe content is unlawful, abusive, unsafe, unauthorized, or inconsistent with these Terms.

9.4 You are responsible for securing your device, account credentials, Apple account, email account, notification settings, and device lock-screen settings. Jailbreaking, rooting, or otherwise weakening device security may expose your information or cause the Application to malfunction.

10. Connectivity, Carrier Charges, and Device Power

10.1 Some Application features require an active Internet connection, working iOS permissions, enabled notifications, available device power, and functioning third-party services. You are responsible for carrier charges, roaming charges, data limits, and device settings controlled by you, your carrier, Apple, or third parties.

10.2 You must keep your device sufficiently charged and connected if you expect CareBear to process motion, check-in, or device activity information. A powered-off device, low battery, disabled permission, disabled notification, expired token, network issue, server outage, or third-party provider outage can prevent or delay CareBear functionality.

11. Accuracy, No Emergency Service, and Disclaimer

11.1 CareBear is a safety-adjacent delayed-message and follower notification tool. It is not a substitute for 110, 119, 911, emergency dispatch, medical monitoring, nursing-care monitoring, private security, rescue, insurance, GPS tracking, or guaranteed safety monitoring.

11.2 CareBear does not guarantee detection of inactivity, detection of an emergency, alert delivery, push delivery, email delivery, Follower response, rescue, medical care, law-enforcement response, or user safety.

11.3 If you believe there is an emergency or immediate risk of harm, call the appropriate emergency service directly. Do not rely on CareBear as your only safety plan.

11.4 The Application is provided "as is" and "as available," except to the extent warranties, liability, or consumer protections cannot be excluded or limited under applicable law.

11.5 Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, or any other liability that cannot be excluded or limited under applicable law.

12. User Obligations and Prohibited Conduct

12.1 You agree not to:

12.2 We may suspend or terminate your account and access to the Application, with or without notice to the extent permitted by applicable law, if we believe you have violated these Terms or are engaged in abusive, unsafe, fraudulent, or unlawful conduct.

13. Updates to the Terms

13.1 We may revise these Terms from time to time. If we make a material change, we will notify you by email, in-app notice, or posting the revised Terms, subject to applicable law.

13.2 The effective date at the top reflects the date of the current version. Continued use of the Application after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

13.3 If applicable law requires a different process for a particular update, we will follow that required process.

14. Termination and Account Deletion

14.1 You may delete your account by following the in-app instructions or by contacting [email protected]. Account deletion and data retention are handled as described in the Privacy Policy.

14.2 We may suspend or terminate your account, block your access, remove content, or revoke your rights under these Terms if you breach these Terms, create risk for other users, engage in abusive or unlawful conduct, or if we are required to do so by law.

14.3 Content and records already delivered to Followers, Apple Push Notification service (APNs), email systems, Follower devices, notification previews, or email inboxes may remain after deletion, termination, or later message changes and cannot be recalled by CareBear.

14.4 Upon termination, you must stop using the Application. Sections that by their nature should continue after termination will continue, including intellectual property, privacy, content restrictions, disclaimers, liability limits, termination and account deletion, applicable law, dispute provisions, and contact provisions.

15. Applicable Law, Consumer Protections, and Disputes

15.1 These Terms and disputes arising out of or relating to them are governed by the laws of Japan, unless applicable law requires otherwise.

15.2 Nothing in these Terms limits mandatory consumer protections, privacy rights, or other non-waivable rights available to users in Japan.

15.3 If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in effect.

15.4 Before starting formal proceedings, you and CareBear agree to try to resolve disputes through good-faith communication using the contact information below, except where immediate legal action or regulatory complaint rights are permitted by applicable law.
